Its not complicated; states and localities (cities, counties, etc.) need only pass the following ordinance:<br>ALL such data centers must be built by, with all permits drawn by and prominent signage on the building and at any perimeter entry points the actual beneficial owners . The use of "captive" LLCs (including multi-level structures) and similar games so if something goes wrong that entity can be bankrupted without hitting the actual beneficial owner(s) and users is prohibited. No legitimate owner who does not intend to stick everyone in the community if they abandon the project or whatever would ever object to this.
All capital expenditure for utilities of any form (specifically but not only electrical and water ) required to provide service to said facility, along with the projected consumption bills of same over the economic life of the capital expenditure (typically 40 years) must be covered by a Surety Bond at 100% of same. An underestimation of expected usage, which shall be audited annually against said filing and bond, shall be assessed with an immediate bonding increase requirement and a 100% penalty of the underestimate due, in cash, to the municipality or other government entity earmarked for rate and capital cost abatement to the impacted persons, other firms and utilities. If a determination is made that said utility request is non-serviceable irrespective of capital expenditure on a permanent basis across the entirety of the expected 40 year service life of said improvements then the permit is summarily denied. The Surety Bond, as performance against said 40 year service life occurs, is reduceable ratably on an annual basis (1/40th per year) until retired.
No rate for any utility service , including but not limited to electrical power, natural or other piped gas, fresh, gray or black water supply or disposal or otherwise may be negotiated that results in an increase in cost to any other ratepayer, with the above Surety Bond being pledged against same with immediate assessment for additional surety is required if such occurs.
No sound emissions , whether in the audible range or not, shall occur at more than 55dba/b at the property boundary or 45dba/b at the closest residential lot or property zoned for same, whichever is less, extending to the maximum permitted height for development or construction at said adjacent and/or closest property.
